Self Drive Terms and Conditions
Welcome to Saferide Car Rental! To ensure a smooth and safe journey in the Philippines, please read our Terms and Conditions. By booking a self-drive vehicle with us, you (the Renter) agree to the following policies. If there are multiple drivers, your obligations are solidary (meaning under Philippine law, the Company can hold any one of the signees fully responsible for the entire agreement).
1. Electronic Signature & Data Privacy Consent
Digital Validity. This Agreement is accepted electronically at the time of booking, when the Renter ticks the "I Agree" checkbox and/or affixes a digital signature. Such electronic acceptance has the same legal force and effect as a handwritten signature, pursuant to the Electronic Commerce Act of the Philippines (R.A. 8792) and its Implementing Rules. Each acceptance is recorded with its date, time, booking reference, and device/IP details, and this electronic record constitutes the executed Agreement between the Company and the Renter.
GPS Tracking & Data Privacy. The vehicle is equipped with a GPS tracking device (where installed on motorcycles). Under the Data Privacy Act of 2012 (R.A. 10173), the Renter gives explicit consent to the Company to monitor and record the vehicle's location for security, asset protection, and legal compliance. Personal data collected during booking and rental is processed solely for these purposes and handled in accordance with the Company's Privacy Policy.
2. Driver Eligibility & Documents
At pickup, the Renter and any Additional Authorized Driver or Rider must personally present valid, physical documents. Photocopies or digital images alone are not sufficient for release.
- Driver's License. A valid physical driver's license is required. For motorcycles, the license must carry the appropriate motorcycle restriction/classification code.
- Foreign Renters. A foreign driver's license is honored in the Philippines for up to ninety (90) days from the holder's date of arrival, provided it is in English or accompanied by an official English translation or an International Driving Permit (IDP). Beyond this period, a Philippine driver's license is required. Foreign Renters must also present a valid passport.
- Identification. At least one additional valid government-issued ID is required.
- Minimum Age & Experience. The Renter must be at least twenty-one (21) years old and hold a license valid for at least one (1) year, unless otherwise agreed in writing.
Only the Renter and drivers/riders named and approved by the Company may operate the vehicle. Allowing an unauthorized person to drive or ride voids all insurance coverage and places full liability on the Renter.
3. Rental Period, Extensions & Repossession
The 24-Hour Cycle. Rentals are based on a 24-hour cycle. Excess hours are charged at 1/6 of the daily rate. Six (6) excess hours or more are billed as a full extra day.
Extensions. Any extension must be requested and approved in writing (or via our digital platform) prior to the original return time.
Criminal Liability Warning. Failing to return the vehicle within 24 hours of the agreed return time without written permission is considered a breach of contract and constitutes prima facie evidence of intent to defraud, punishable as Estafa or Carnapping under Philippine law.
Right of Repossession. The Company reserves the right to terminate this Agreement and repossess the vehicle immediately, without prior notice and at the Renter's expense, if the vehicle is illegally parked, abandoned, or used in violation of these terms.
4. Financial Terms, Security Deposit & Refuel/Recharge Policy
No Refund Policy. All rental fees must be paid in advance. Unused rental hours or days are strictly non-refundable.
Security Deposit. A security deposit in the amount stated in the Rental Details is collected upon release. The deposit is refunded within seven (7) banking days after the vehicle is returned and inspected, less any deductions, which will be itemized and communicated to the Renter.
Fuel Policy — ICE Vehicles & Motorcycles (Full-to-Full). Gasoline and diesel vehicles and motorcycles are provided with a full tank and must be returned full. Otherwise, refueling costs plus a service surcharge will be deducted from the deposit.
Charging Policy — Electric Vehicles (80%-to-80%). EVs are supplied with at least an 80% State of Charge (SoC) and must be returned with a minimum 80% charge. Returning an EV below this threshold, or with a critical charge level (below 20%), will incur recharging fees and battery health risk surcharges as detailed in our standard EV Rate Sheet.
Keys, Charging Accessories & Provided Gear. The Renter is strictly liable for all keys and key fobs, and for all EV charging cables and adapters, motorcycle helmets, top boxes, and other accessories provided. Lost or damaged equipment is charged at full replacement cost, including reprogramming of keys or fobs where applicable.
Late Payments. Any unpaid balances shall incur a penalty interest of 1.5% per month (18% per annum).
Disputes & Legal Action. The Renter agrees to pay 20% of the amount due for attorney's fees (minimum ₱10,000) plus court costs if legal action is required to collect debts or recover the vehicle.
5. Renter's Responsibilities on the Road
Under the Philippine Civil Code (Article 1163), the Renter is legally bound to care for the vehicle with the "diligence of a good father of a family." The Renter is fully responsible for:
- Strictly complying with all Philippine traffic laws.
- Paying out-of-pocket for all fuel, EV charging, tolls, parking fees, and traffic violation fines (including LTO alarms and No-Contact Apprehension penalties).
- Paying for all tire damage, including patches, vulcanizing, or full tire replacement.
- All release fees, penalties, and lost daily rental income if the vehicle is impounded due to the Renter's traffic violations.
Additional duties for Electric Vehicles (EV):
- Immediately informing emergency first responders and police at the scene of any accident that the involved vehicle is electric, due to high-voltage safety requirements.
- Using only compatible, approved charging stations and the equipment provided. Damage caused by unauthorized, modified, or defective charging equipment is the Renter's full responsibility.
Additional duties for Motorcycles:
- Ensuring the rider and any back-rider wear standard protective helmets at all times, in compliance with the Motorcycle Helmet Act of 2009 (R.A. 10054).
- Keeping the license plate visible, unobstructed, and unmodified at all times, in compliance with the Motorcycle Crime Prevention Act (R.A. 11235).
- Carrying a maximum of one (1) back-rider and never exceeding the unit's rated load capacity.
- Observing expressway restrictions: motorcycles below the minimum engine displacement required by tollway regulations are prohibited on expressways.
- Using the steering lock and any provided anti-theft devices whenever the unit is parked. Keys must never be left with the unit.
6. Prohibited Uses & Specific Penalties
To ensure safety and protect the asset, the vehicle shall not be used:
- Beyond the Island of Release. The vehicle must remain on the island where it was released and shall not be taken to another island without prior written consent.
- For Inter-Island Travel. Loading the vehicle onto a RoRo ferry is strictly prohibited without prior written consent from Saferide (marine insurance is required).
- In Flooded Areas. The Renter is fully liable for engine, electrical, or EV high-voltage battery damage caused by driving through flooded roads, even if unintentional.
- For Hazardous, Foul, or Staining Items; Smoking; or Pets. Carrying foul-smelling items (e.g., durian, wet seafood), staining materials, or hazardous goods; smoking or vaping inside the vehicle; or transporting pets inside the cabin is prohibited. Each violation results in a minimum ₱2,500 detailing penalty.
- Off-Road. Driving off-road, on beaches, on trails, or in areas of conflict. For EVs: driving over high curbs or rough, unpaved terrain that risks striking or scraping the high-voltage undercarriage battery pack is strictly prohibited. Motorcycles may only be taken off-road if the unit is expressly designated off-road-capable by the Company with prior written consent.
- For Racing or Stunts (Motorcycles). Racing, drag riding, stunt riding, or any competitive or exhibition use is strictly prohibited.
- For Unauthorized Commercial Use. Commercial transport or towing without authorization; for motorcycles, this includes habal-habal, ride-hailing, and courier services.
- Under the Influence. By anyone under the influence of alcohol or drugs, or by individuals with pending criminal charges.
7. Insurance Options, Accidents & Exclusions
Except in cases of the Company's gross negligence, liability is strictly limited to ₱100,000 for bodily injury and ₱100,000 for property damage.
Personal Accident Insurance (PAI). Covers accidental injury or death up to ₱50,000 per person, up to the vehicle's maximum seating capacity. PAI is strictly NOT available for motorcycle rentals — the Renter and any back-rider ride at their own risk and are strongly advised to carry their own personal accident coverage.
Accident Protocol. In the event of an accident, damage, or theft, the Renter must immediately notify the Company and secure a Police Report. The Renter must also provide a copy of their Driver's License and Passport (if foreign). Failure to submit these documents entirely voids all insurance coverage, making the Renter fully liable for all repair costs and lost income.
Collision Damage Waiver (CDW). If the vehicle is damaged, the Renter pays the standard Participation Fee/Deductible as specified in the specific Rental Details or Invoice for the assigned vehicle.
Strict Exclusions. Standard insurance explicitly excludes, and the Renter is fully liable for:
- Damage to windscreens, glass, mirrors, and lights.
- Tires and wheels.
- Interior damage.
- Undercarriage damage — including, for EVs, the high-voltage battery pack casing.
- For motorcycles: fairings, exhaust/mufflers, and damage resulting from the unit falling or tipping over while parked.
Theft Prevention. The Renter must use all provided locks and anti-theft devices whenever the vehicle is unattended. Keys must never be left in or with the vehicle.
Fortuitous Events (Acts of Nature). If the vehicle is damaged by an insured natural disaster (e.g., typhoon, flood), the Renter remains responsible for paying the CDW Participation Fee.
Full Coverage Option (RentalCover.com): For total peace of mind—including zero-deductible options and protection for items we specifically exclude (like tires, EV undercarriages, and glass)—you may purchase comprehensive third-party insurance through our partner, RentalCover.com.
8. Mechanical Issues, Breakdowns & Personal Property
- The Company is not liable for indirect or consequential losses (e.g., missed flights, hotel cancellations) due to mechanical delays.
- The Renter must not attempt to repair the vehicle, tamper with electrical or high-voltage lines, or replace parts without the Company's written approval.
- Fuel or Charge Depletion. If an ICE vehicle or motorcycle runs out of fuel, is filled with the wrong fuel type, or if an EV runs completely out of charge on the road, this is considered Renter error. The Renter is fully responsible for towing and recovery fees (for EVs, specialized towing to the nearest charging station or Saferide branch), any fuel-system draining or repair costs, and all resulting downtime.
- The Company is not responsible for lost, stolen, or damaged personal items left inside the vehicle, top box, or under-seat compartment.
9. Governing Law, Venue & Severability
Exclusive Venue. Any and all legal disputes arising from this Agreement shall be filed exclusively in the proper courts of the city or municipality where the Saferide branch that released the vehicle is located, to the exclusion of all other courts.
Language. This Agreement is executed in English. In case of any discrepancy between the English text and any translated version, the English text prevails.
Severability. If any provision of this Agreement is found to be invalid or unenforceable under Philippine law, the remaining provisions shall continue in full force and effect.
With Driver & Tours Terms and Conditions

By booking a chauffeur-driven vehicle or tour with us, you (the Renter) agree to the following policies. If there are multiple passengers, the lead Renter's obligations under this agreement are solidary (meaning under Philippine law, the Company can hold the signee fully responsible for the entire agreement).
1. Privacy, Data Protection, & GPS Tracking
Data Privacy: We respect your privacy. In compliance with the Philippine Data Privacy Act of 2012 (R.A. 10173), we only collect the personal information necessary to process your booking, verify your identity, and provide a great experience. We will never share your information with unauthorized third parties.
GPS Tracking: For your safety, asset protection, and legal compliance, our fleet is equipped with GPS tracking. By renting with us, you explicitly consent to the monitoring and recording of the vehicle's location during your trip.
2. Reservations, Cancellations, and Refunds
To secure your booking, a Reservation Fee ranging from 20% to 100% is required, depending on the vehicle and services chosen.
Refund Policy: Unconsumed rental days or hours are non-refundable. Any finance, bank, or refund processing charges (such as international credit card or wire transfer fees) will be borne by the Renter.
Cancellation Fees: If your travel plans change, the following cancellation fees apply:
Less than 7 days before rental: 20% of Reservation Fee
Four (4) days before rental: 50% of Reservation Fee
Three (3) days or No Show: 100% of Reservation Fee (Full forfeiture)
3. Service Hours and Extensions
Rental Period: Your service time starts exactly upon boarding or 30 minutes after your scheduled pickup time, whichever comes first. The standard service duration (e.g., 10 hours) is indicated on your specific booking or vehicle product page.
Extensions: Any use of the vehicle and driver beyond the booked hours will automatically incur an hourly Extended Service Fee, as specified on the product page.
4. Inclusions and Extra Costs
Exclusions: Unless you explicitly booked an "All-In" package, the Renter is responsible for paying all toll fees, parking fees, and any extra fuel required for route deviations outside the agreed itinerary.
Driver Meals & Lodging: Providing meals for your driver is highly appreciated but entirely optional. However, if your itinerary requires an overnight stay outside the driver's base city, the Renter must either provide safe driver accommodation or pay the standard Overnight Lodging Fee specified on the product page.
5. Safety, Routing, and Capacity
Strict Compliance: In accordance with the Seat Belts Use Act of 1999 (R.A. 8750), all passengers must wear seatbelts at all times. Vehicle passenger and luggage capacities are strictly limited to the manufacturer’s safe specifications and cannot be exceeded.
Driver Authority: For your absolute safety, our chauffeurs have the final authority on routing. They reserve the right to refuse to drive through flooded, unpaved, or visibly hazardous areas. Furthermore, Renters may not instruct, pressure, or incentivize drivers to break any Philippine traffic laws.
6. Insurance & Activity Exclusions
Because a Saferide employee is operating the vehicle, you do not need to purchase Collision Damage Waiver (CDW) or third-party vehicle insurance.
Passenger Coverage: The vehicle is fully covered for third-party property damage and includes Personal Accident Insurance (PAI) up to ₱50,000 per passenger.
Important Exclusions: This insurance strictly covers passengers only while actively riding inside the vehicle. It does not cover accidents, injuries, or liabilities that occur outside the vehicle during tours, island hopping, or other availed activities. Personal belongings and luggage left in the vehicle are also not covered.
7. Interior Damage and Cleaning
While the Renter is completely free from liability regarding traffic accidents or exterior vehicle damage, the Renter remains fully responsible for the care of the vehicle's interior.
Cleaning Penalties: Deep-cleaning fees (minimum ₱2,500 or as listed on the product page) will be strictly charged for heavy staining, vomiting, smoking/vaping inside the cabin, or bringing foul-smelling items (such as durian or wet seafood).
8. Breakdowns and Delays
In the event of a mechanical breakdown, Saferide will attempt to dispatch a replacement vehicle as quickly as possible.
We are not liable for indirect losses, inconveniences, or consequential damages (such as missed flights, ferry departures, or hotel cancellations) caused by extreme weather, heavy traffic, or mechanical delays.
9. Termination and Indemnification
Zero Tolerance: Saferide reserves the right to terminate the service immediately, without refund, if the Renter or any passenger engages in illegal activities, consumes illegal drugs, or exhibits abusive, threatening, or harassing behavior toward the driver.
Indemnification: The Renter agrees to indemnify and hold Saferide free from any claims, fines, or expenses arising strictly from the Renter's own negligence, illegal acts, or breach of these terms.
10. Disputes and Late Payments
Late Payments: Unpaid balances or extended service fees will incur an interest rate of 1.5% per month (18% per annum).
Legal Action & Venue: We prefer to resolve issues amicably. However, if legal action is required, the Renter agrees to pay 20% of the amount due for attorney’s fees (minimum ₱10,000) plus court costs. Any legal disputes shall be filed exclusively in the proper courts of the city or municipality where the Saferide branch that dispatched the vehicle is located, to the exclusion of all other courts.
